If a minor child is not traveling with both parents, it may make sense to authorize the accompanying person.

Who can travel with my child?

"Both parents are usually entitled to joint custody of the child," says Martin Thelen, press officer at the Federal Chamber of Notaries. This is why a so-called travel power of attorney is not only useful if neither parent accompanies the child on the trip, but also if one parent is traveling alone with the child and does not have sole custody.

When do I need a travel authorization?

The Federal Foreign Office recommends a travel authorization whenever a child is not accompanied by both parents on a trip abroad. This makes it easier for the border police to rule out child abduction or unauthorized removal of the child from the sphere of influence of a parent or guardian.

In addition, the entry regulations of various countries require a corresponding declaration of consent or travel authorization. "Before traveling abroad, it is therefore essential to find out about the valid entry regulations, e.g. via the website of the Federal Foreign Office," advises Thelen.

What does a travel authorization look like?

"Powers of attorney for travel are usually limited to an informal declaration of consent from the person(s) with custody," reports Thelen. Samples and forms for powers of attorney for travel can be found on the Internet, for example on the homepage of the Federal Foreign Office. In addition to the declaration of consent, a power of attorney for travel should contain the full personal details of both the person granting the power of attorney and the minor(s) as well as the accompanying person(s). "I personally recommend including the telephone number of the person granting the power of attorney," advises Thelen. "This enables the authorities to make any queries". It is also advisable to attach copies of the identity documents of the legal guardians and a copy of the minor's birth certificate to the power of attorney. You can find out which documents are required in detail from the diplomatic mission of the destination country and on the website of the Federal Foreign Office.

When to see a notary?

"Notarization is not required in every case," informs Thelen. "In many countries, an informal declaration of consent is sufficient." Some countries, such as Greece or Bosnia and Herzegovina, only accept the power of attorney if it is notarized. In some countries, an apostille or legalization is also required. "In cases of doubt, you should have the travel power of attorney notarized by a notary in order to avoid any problems with recognition in the country of travel from the outset," recommends Thelen.

In which language should the travel authorization be written?

"To ensure that the travel authorization is recognized at the destination, it should be written in English or in the language of the destination country. Many forms and templates are multilingual. A translation is then not necessary," adds Thelen in conclusion.

You can find further press releases from the media association on all topics related to the notary's office in the Press portal of the media association of the chambers of notaries.

Many families use the school vacations to travel.
