Much of this content, such as photos, can encroach deeply on our privacy. But what happens in the event of our death? The fact that digital legacies also need to be regulated in good time is still all too rarely considered.

Majority of Germans have not yet made provisions

Although four out of ten Germans are now taking care of their digital legacy, according to a survey conducted by the industry association bitkom in December 2021 - a year earlier it was only three out of ten - the figures also clearly show that the majority of respondents have not yet addressed this issue. Our digital legacy is just as important as our material legacy and is also subject to legal regulations.

Digital estate part of the estate

Depending on the terms and conditions, a contract does not automatically expire upon the death of the contract holder, but is included in the estate. Like letters and other analog documents, emails and other digital products also form part of the estate. If you want to make sure that information ends up in the right hands after your death, you need to take action during your lifetime and make some arrangements.

Create a list of all accounts and passwords

In order to be able to inherit the digital legacy at a later date, the entitled survivors need the access data. The first step is therefore to create a list of all existing digital accounts and passwords. This should be updated regularly and stored in a particularly secure location to prevent data theft.

Data particularly secure at the notary

Data is particularly secure with a notary. This also helps to regulate the digital estate in a will, in which it is explained who should enforce your will on your behalf if you are no longer able to do so yourself one day. If the estate plan is supplemented by a power of attorney, this should always include the clause that it applies beyond death.

Dealing with the digital legacy

It is also important to determine what to do with the digital estate. What should happen to social media accounts? Should they be deleted or - if possible - should the "in memoriam" function, a digital memorial status, be used? Which documents are heirs allowed to read, should certain documents be destroyed after death or perhaps divided among several heirs?

You can find further news at https://ratgeber-notar.de/.

Whether on social media, streaming services, in the form of email accounts, blogs and vlogs, customer accounts on shopping sites or through the increasingly digital management of our lives - we all leave traces on the World Wide Web.
